Nature of the Service

Kapitus operates an advertising and referral service connecting consumers with participating lending partners. We are not a lender, bank, credit union or loan broker. We do not make credit decisions, originate loans, service loans or collect payments. Submitting a Kapitus funding request does not constitute an application to us and does not guarantee any offer.

Eligibility to Use

You must be at least 18 years old, or the age of majority in your state, and a resident of the United States. You must provide accurate, current and complete information. Submitting false information in connection with a credit request may constitute a criminal offence.

Your Responsibilities

  • Provide accurate information about yourself only. Submitting a Kapitus Funding funding request using another person's details is prohibited.
  • Read any loan agreement in full before signing it.
  • Direct servicing questions to the lending partner holding your loan.
  • Do not use this site for any unlawful purpose, and do not attempt to interfere with its operation.
  • Do not scrape, republish or commercially reuse content from this site without permission.

Content on this site is general information only. It is not legal, tax, financial or investment advice, and it does not take account of your individual circumstances. Third-Party Relationships

Lending partners are independent businesses. We do not control their underwriting, pricing, servicing, communications or conduct, and we are not responsible for them. Accuracy of Information You Provide

You agree that all information submitted through this site is true, accurate and complete to the best of your knowledge, relates to you personally, and is provided with your authority. Submitting a credit request using another person's identity is unlawful in every state and will be reported.

You agree to keep contact details current while a request is in progress. Notices sent to the address or number you provided are treated as delivered.

Availability of the Site

We aim to keep this site available but do not guarantee uninterrupted access. Maintenance, technical failure, or circumstances outside our control may cause interruption. We may modify, suspend or discontinue any part of the site at any time without notice and without liability.

Indemnity

You agree to indemnify and hold harmless Kapitus Funding, its officers, employees and agents from any claim, loss, liability or expense arising out of your use of this site, your breach of these terms, or your violation of any law or the rights of a third party.

Dispute Resolution and Severability

Any dispute arising out of these terms or your use of this site should first be raised with us in writing so it can be addressed directly. What These Terms Do Not Cover

This document governs your use of the Kapitus website. It has no bearing on any loan agreement you sign, which is a separate contract between you and a lending partner, governed by its own terms and by the consumer lending law of your state.

The distinction matters when something goes wrong. A dispute about this site is a matter for Kapitus. A dispute about a loan is a matter for the partner, your state regulator, and the Consumer Financial Protection Bureau — and nothing written here limits those routes.
