What States Control

  • Licensing. A lender must generally hold a licence in each state where it lends. Licensing is expensive, which is why smaller lenders operate in limited footprints.
  • Rate ceilings. Many states cap the rate that may be charged on consumer loans, sometimes varying by loan size.
  • Permitted fees. Which fees may be charged, and how they must be disclosed.
  • Minimum and maximum amounts. Some states restrict loan sizes for particular product types.
  • Term limits. Minimum and maximum repayment periods for certain products.
  • Prohibited products. Some states restrict or prohibit certain short-term lending entirely.

What This Means in Practice

Three consequences follow directly.

The number of partners who can quote you varies. A borrower in a state where many partners hold licences will typically see more offers than one in a state where few do.

Pricing differs. A state with a rate ceiling produces different offers from one without, for the same credit profile.

Some products are simply unavailable. No amount of credit strength changes a statutory prohibition.

Checking What Applies Where You Live

  1. Find your state banking or financial regulation department. Every state has one, and most publish plain-language consumer guidance.
  2. Search the licence register for any lender that contacts you. Match the entity name and address precisely.
  3. Read the state's consumer lending page for rate ceilings and product restrictions.
  4. Check the Consumer Financial Protection Bureau for federal-level guidance and its public complaint database.

These checks take a few minutes and rule out an entire category of fraud, because unlicensed operations cannot appear on a state register.

If You Move

An existing loan continues under the terms of the agreement you signed — moving does not change it. Notify your lending partner of the new address promptly, since notices delivered to an old address are still legally delivered.

Any new request after moving is assessed under the rules of your new state, which may mean different partners, different pricing, or different products available to you.

What Varies and Why It Matters to You

Varies by statePractical effect on your Kapitus Funding funding request
Which lenders hold licencesHow many partners can make you an offer
Maximum permitted rateThe ceiling on what you can be charged
Permitted feesWhether an origination fee can apply and how much
Minimum and maximum loan sizeWhether your requested amount is available
Minimum and maximum termWhich repayment schedules can be offered
Product prohibitionsWhether certain products exist at all where you live
Deposit and disclosure rulesDocumentation you receive and when

None of this is negotiable by a lender or by us. It is statutory, and a lender operating outside it is operating unlawfully — which is precisely why licence verification is worth the few minutes it takes.

Verifying a Lender in Four Minutes

  1. Search for your state's banking or financial regulation department directly rather than following a link you were sent.
  2. Open its licence register and search the exact entity name you were given.
  3. Check that the registered address and contact details match what the lender told you.
  4. Search the same name in the Consumer Financial Protection Bureau complaint database.

An entity that does not appear on the register for your state cannot lawfully lend to you there. That single check eliminates an entire category of fraud, including operations that impersonate real licensed lenders using slightly altered names or domains.

Borrowing Across State Lines

The state that governs your loan is generally the one where you reside, not where the lender is headquartered. A lender based in one state lending into another must comply with the receiving state's rules, which is why national lenders offer different terms in different places.

If you are in the process of moving, complete the Kapitus funding request from the state where you currently reside and where your documentation shows you living. Submitting from an address you have not yet moved to creates verification mismatches, and verification mismatches are the most common cause of a stalled request.

The Constraint Nobody Can Negotiate

Borrowers occasionally ask whether Kapitus can find a partner willing to exceed what their state permits. It cannot, no partner would, and an operation offering to is not a licensed lender.

State statutes sit above every other variable in this process. They determine which Kapitus Fundings partners can quote you at all, what the ceiling on your rate is, which fees may be charged, and whether particular products exist where you live. A strong credit file changes your position within those limits and never the limits themselves.

This is also the reason licence verification is worth four minutes. An entity absent from your state's register cannot lawfully lend to you there, whatever it claims — and checking rules out an entire category of fraud before any Kapitus funding request is even submitted.

A Kapitus funding request is routed only to Kapitus partners licensed where you live, which is why the same request produces different results in different states. Kapitus Funding cannot widen that set, and no Kapitus lending partner will exceed a statutory ceiling. Verifying any lender on your state register before accepting a Kapitus loan takes four minutes and rules out an entire category of fraud.
